日盈观点|美国堕胎权的争议及由来

  在美国等待归国航班的日子里,我一早就获知了这个新闻。这个新闻看似一个判决,却有可能引发社会的对立与州之间的割裂。
 
  国内的小伙伴可能都看见了罗诉韦德案(Roe v. Wade 410 U.S. 113)被推翻,但是却不知道事情究竟是怎么一回事。我来给大家理一下时间顺序和理由。因为其中还牵涉到罗案后续一个先例被推翻,那就是美国联邦最高法宾州东南部计划生育组织诉凯西案先例(Planned Parenthood v. Casey 505 U.S. 833)(以下分别简称罗案与东南案)。
 
  笔者认为,东南案才是更加贴切被现在案件所推翻的先例
 
  2022年6月24日美国联邦最高法院以6-3多数在一个多布斯诉杰克逊妇女健康组织案(Dobbs v. Jackson Women's Health Organization 该案尚未归档,所以没有档案号)中推翻了罗案的先例。美国联邦最高法院否认堕胎权是美国宪法赋予的权利。
 
  事情的起因是关于密西西比州一项法律,该法律于2018年颁布,旨在阻止15周后妇女进行堕胎手术,除非是紧急情况,但是紧急情况不包括强奸和乱伦。该法案引发争议,因为这个与东南案中所推导的采用胎儿存活能力作为标准(这通常是指怀孕24周后胎儿在子宫外存货的能力。)
 
  罗案是美国联邦最高法院初步认证妇女的堕胎权是归纳于美国宪法第十四修正案中的正当权利,但是尚未进行细化。而东南案则是明确了堕胎权是妇女的一项宪法性权利,并大致明确了妇女在当时24周前是可以自由处置自己的堕胎权。
 
  下面便是引自东南案的多数法官意见:
 
  Constitutional protection of the woman's decision to terminate her pregnancy derives from the Due Process Clause of the Fourteenth Amendment. It declares that no State shall "deprive any person of life, liberty, or property, without due process of law." The controlling word in the cases before us is "liberty." (Planned Parenthood v. Casey, 505 U.S. 833, 846, 112 S. Ct. 2791, 2804 (1992))
 
  宪法对妇女自我意志结束她们的怀孕之保护源自第十四修正案中的“正当程序”。宪法宣称没有州可以在没有正当程序状态下,剥夺任何人的生命,自由,财产。这些案件中,摆在我们面前的关键词就是“自由”。
 
  Our law affords constitutional protection to personal decisions relating to marriage, procreation, contraception, family relationships, child rearing, and education. Carey v. Population Services International, 431 U.S. at 685. Our cases recognize "the right of the individual, married or single, to be free from unwarranted governmental intrusion into matters so fundamentally affecting a person as the decision whether to bear or beget a child." Eisenstadt v. Baird, supra, at 453 (emphasis in original). Our precedents "have respected the private realm of family life which the state cannot enter."  [****38]  Prince v. Massachusetts, 321 U.S. 158, 166, 88 L. Ed. 645, 64 S. Ct. 438 (1944). These matters, involving the most intimate and personal choices a person may make in a lifetime, choices central to personal dignity and autonomy, are central to the liberty protected by the Fourteenth Amendment. At the heart of liberty is the right to define one's own concept of existence, of meaning, of the universe, and of the mystery of human life. Beliefs about these matters could not define the attributes of personhood were they formed under compulsion of the State. (Planned Parenthood v. Casey, 505 U.S. 833, 851, 112 S. Ct. 2791, 2807 (1992))
 
  我们的法律保障个人在宪法上的对于婚姻、生育、避孕、家庭关系、孩子抚养及教育的权利。这是源自Carey v. Population Services International案件先例的。我们的先例辨析出“个人,无论结婚抑或单身,都享有不受无端政府的干涉其决定是否抚养或生育孩子的权利”这是源于Eisenstadt v. Baird案的先例。我们的先例有着“尊重家庭私人领域不被州政府所干涉”的传统。这是Prince v. Massachusetts案的传统。这些案件,涉及人一生中做出的一生中可能做出的最亲密和最个人的选择,这些选择对个人尊严和自主至关重要,也对第十四条修正案所保护的自由至关重要。自由的核心是有权定义自己的存在、意义、宇宙和人类生命奥秘的概念。关于这些问题的信念如果是在州的强迫下形成的,就不能确定人格的属性。
 
 
 
  嗯,然后这个案例被推翻了,现在的案子大刺刺直接说,堕胎权不是宪法权利。

  We hold that Roe and Casey must be overruled. The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including the one on which the defenders of Roe and Casey now chiefly rely – the Due Process Clause of the Fourteenth Amendment. That provision has been held to guarantee some rights that are not mentioned in the Constitution, but any such right must be 'deeply rooted in this Nation's history and tradition' and 'implicit in the concept of ordered liberty. It is time to heed the Constitution and return the issue of abortion to the people's elected representatives.
 
  我们认为罗案和东南案都必须被推翻。宪法并没有提及堕胎权,并且这个权利并不包含于宪法任何条款中的内部含义,包括那些罗案和东南案的拥护者所依赖的第十四修正案中的正当权利。这项条款仅仅是保证那些宪法中没有提及、但是“深深根植于本国的历史和传统中”及“隐含在有序自由概念中。现在是时候注意宪法问题并且将堕胎权利归于民选的代表手中了。”
 
  Stare decisis, the doctrine on which Casey’s controlling opinion was based, does not compel unending adherence to Roe’s abuse of judicial authority. Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division.
 
东南案所仰赖的“遵循先例”传统,并不能迫使无休止的司法上对罗案的滥用。罗案从一开始就错了。该案的逻辑出乎意料地弱,并且决定损害了结果。并且不同于国家对于堕胎话题的争议尘埃落定,罗案与东南案引发了无休止的争议和加深了人们的隔阂。
 
  嗯,很少见现今的联邦最高法院大法官如此激烈地去批评他们前任做出的判决。并且冠以逻辑推论弱的名义。
 
  这个案件导致的结果将是,那些保守州悬而未决的反堕胎法将会依照州法迅速通过或者30天后通过,持观望态度的州也有可能会修改自身法律进而影响堕胎手术的进行。而偏向民主党的州将会继续支持堕胎法案,并且吸引保守州却希望堕胎的民众进行迁移,防止进一步的迫害。这张CNN的视频截图将大致说明情况(截图源自https://www.cnn.com/2022/06/24/politics/dobbs-mississippi-supreme-court-abortion-roe-wade/index.html)
 
  
 
  将图上四个图合并,将会接近美国的一半州,他们将会在本案后对堕胎问题进行禁止或者严格限制。几乎占美国一半的国土面积,这种撕裂远远超过“黑命贵”运动。
 
  黑人要求平等的运动与即将到来的堕胎争议相比,可能体量上不在同一个层次。在判决出来后,众议院议长和美国总统都对这个判决进行谴责,并且声称这个判决使得美国历史倒退了150年。
 
  这便是美国堕胎争议为何会引发如此多的关注的缘由。
